Based on the facts before it, there was clearly a sufficient basis for the Legislature to believe that the elected county clerk in Harris County was more competent regarding election administration than the appointed elections administrator.
The main object of SB 1750 is to improve the competency of the person assigned to administer elections in counties with a population of more than 3.5 million.


However, there is no basis for believing that, as a general rule, elected county clerks in counties over 3.5 million in population are more competent regarding election administration than an appointed elections administrator.
