Article XV, Section 5 of the Texas Constitution ("Suspension Pending Impeachment; Provisional Appointment")

Adopted February 15, 1876:

All officers against whom articles of impeachment may be preferred shall be suspended from the exercise of the duties of their office, during the pendency of such impeachment. The Governor may make a provisional appointment to fill the vacancy occasioned by the suspension of an officer until the decision on the impeachment.

Editor Comments

If the Governor is impeached, the Lieutenant Governor, pursuant to Article IV, Section 16(c), exercises "the powers and authority appertaining to the office of Governor" during the pendency of such impeachment.
